Taiwan’s Ex-Im Bank pursues 1991 loan to DR Congo but no progress DR Congo says not a priority

SDNY COURTHOUSE, Feb. 28 – Taiwan or the Republic of China lent Zaire Now DR Congo $20 million in 1991. Now the DRC is not paying and Taiwan has sued.
Ex-Im Bank of Taiwan filed a status report with U.S. District Court for the Southern District of New York Judge Jesse M. Furman on Dec. 29; Inner City Press found it in the file.
Taiwan’s Ex-Im Bank lawyer says he met with DRC Justice Minister Rose Mutombo – but nothing has happened since, according to Benita Kindongo.
On January 5, Judge Furman held a conference and Inner City Press covered it. Taiwan’s lawyer raised the possibility of involving the US State Department and noted that he was successful in getting Niger to repay (part of) its loan to Taiwan, albeit after 15 years effort.
Judge Furman said the penalties are not meant to be punitive and may not have an impact here. He directed Ex-Im Bank of Taiwan’s attorney to address the matter in his next status letter as well as to meet and confer with Ivanhoe Mines US LLC to restrict or withdraw his subpoena as being irrelevant.
On February 28, the lawyer for the civil party wrote to Judge Furman in particular that Benita Kindongo based in Paris told them that “with all the economic difficulties caused by the health crisis, the EXIMBANK file is not a priority for the agenda, in particular the budgetary agenda” of the DRC. In addition, Mr. Kindongo said she had spoken with the DRC justice minister and was expected to make a settlement offer in two weeks.
